Motion filed to set aside Collins ruling
A new lawyer for Kansas guard Sherron Collins has filed a motion to set aside a judge's ruling in a lawsuit concerning an assault a woman alleged took place on an elevator.
The motion, filed by attorney Christopher Burger in Douglas County District Court on Wednesday, states that Collins did not intentionally ignore notices of the lawsuit when it was filed May 14. The motion states that Collins was not aware that a previous attorney - hired to handle the case for him - had ended their attorney-client relationship.
On Monday, Judge Jack Murphy signed a journal entry in the case granting judgment for damages in excess of $75,000 to Jessica J. Brown. Murphy ruled in Brown's favor because Collins failed to file a legal response to the lawsuit within 20 days.
In the lawsuit, Brown accused Collins of exposing himself and rubbing against her on May 18, 2007, in an elevator at a University of Kansas apartment complex.
Burger said Collins denies assaulting Brown.
Collins is the top returning player for the national champion Jayhawks, who lost three underclassmen - Brandon Rush, Mario Chalmers and Darrell Arthur - to the NBA draft.
